Squishy's Leap (PlayStation®5): End User License Agreement & Privacy Policy

This End User License Agreement and Privacy Policy ("Agreement") governs your access to and use of Squishy's Leap (the "Game"), developed and published by JVM Arcade LLC ("Publisher," "we," "us," or "our") for the PlayStation®5 system. This Agreement applies only to the PlayStation®5 version of the Game. If the Game is released on other platforms, each version is governed by its own separate agreement.

By downloading, installing, or playing the Game, you agree to this Agreement. If you do not agree, do not download, install, or use the Game.

This Agreement has two parts: a Privacy Policy, describing what information we collect and how we use it, and an End User License Agreement (EULA), describing the terms under which we license the Game to you. Together they form a single agreement between you and the Publisher.

Part 1: Privacy Policy

Information we collect

Account and platform information. When you play the Game on PlayStation®5, Sony Interactive Entertainment ("SIE") makes certain information tied to your PSN account available to the Game, as permitted by SIE's platform policies, such as your online ID and region.

Gameplay data. Progress, scores, leaderboard rankings, trophies, and session statistics (for example, levels completed or attempts at a level), so the Game and its leaderboards work correctly.

Leaderboard data sent to our service provider. In addition to PlayStation Network's built-in leaderboards, we record scores using SilentWolf, a third-party leaderboard service. When you post a score, the Game sends SilentWolf your player name and your score. We do not receive your IP address. Like most online services, SilentWolf may process technical information such as IP addresses in its own server logs to deliver its service; that processing is governed by SilentWolf's own privacy policy.

Support communications. If you contact us for support, we keep your message and contact details so we can respond.

We do not collect more information than the platform and the Game's features require. We do not collect payment information. All purchases are handled by SIE through PlayStation Store.

How we use this information

• To run the Game's features, including saving progress and the leaderboards.

• To fix bugs and improve performance and balance.

• To respond to support requests.

• To comply with legal obligations and enforce this Agreement.

We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.

Sharing

With SIE. The Game is distributed through PlayStation Store and runs on SIE's platform. Some data, such as trophies, PSN leaderboard entries, and platform telemetry, is processed by SIE under SIE's own privacy policy, which governs your PSN account separately from this Agreement.

With service providers. We share leaderboard data with SilentWolf only to operate the Game's leaderboards. Its servers may be located in the United States or other countries.

For legal reasons. We may disclose information if required by law or to protect our rights, our players, or others.

Players of all ages

The Game is suitable for players of all ages. It is not specifically directed to children. We do not knowingly collect personal information directly from children, beyond what passes through SIE's platform, which is governed by SIE's parental controls and account systems. If you believe a child has provided us personal information directly, contact us and we will delete it.

Data retention and security

We keep gameplay, leaderboard, and support data for as long as needed to operate the Game and meet legal obligations, then delete or anonymize it. We use reasonable safeguards to protect the information we hold, but no method of storage or transmission is completely secure.

Your rights

Depending on where you live, you may have the right to access, correct, or delete personal information we hold about you, to object to or restrict certain processing, and to complain to your local data protection authority. To exercise these rights, including to have your scores removed from our SilentWolf leaderboard, contact us using the details below. We will respond within the time required by applicable law.

Part 2: End User License Agreement

License grant

Subject to your compliance with this Agreement and SIE's terms of service, Publisher grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Game on PlayStation®5 systems associated with your PSN account, for your personal, non-commercial entertainment.

Restrictions

You agree not to:

• Copy, modify, adapt, translate, or create derivative works of the Game, except as permitted by SIE's platform features.

• Reverse engineer, decompile, or disassemble the Game, except to the extent applicable law expressly permits.

• Rent, lease, sell, sublicense, or otherwise transfer the Game or your license, except through mechanisms SIE provides.

• Use cheats, automation tools, exploits, or unauthorized third-party software to interfere with gameplay, the leaderboards, or other players' experience.

• Use the Game for any unlawful purpose or in violation of SIE's platform rules.

We may remove leaderboard entries we reasonably believe were obtained through cheating or exploits.

Ownership

The Game, including its code, art, characters, music, and all related intellectual property, is owned by Publisher and its licensors and is protected by copyright and other intellectual property laws. This Agreement grants you a license to use the Game. It does not transfer ownership of the Game to you.

Disclaimer of warranty

The Game is provided "as is" and "as available," without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such disclaimers are not permitted by applicable law.

Limitation of liability

To the maximum extent permitted by law, Publisher will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of or inability to use the Game, even if advised of the possibility of such damages. Publisher's total liability for any claim arising from this Agreement will not exceed the amount you paid for the Game, if any. Nothing in this Agreement limits liability that cannot be limited under applicable law.

Term and termination

This Agreement remains in effect until terminated. Your license ends automatically if you fail to comply with its terms. Publisher may also suspend or end your access to the Game to comply with SIE's platform policies or applicable law. When the license ends, you must stop using the Game. Sections that by their nature should survive termination (including Ownership, Disclaimer of Warranty, Limitation of Liability, and Governing Law) will survive.

Governing law

This Agreement is governed by the laws of the State of Nevada, USA, without regard to conflict-of-law principles, except where your local consumer-protection law requires otherwise. Any dispute arising from this Agreement that is not otherwise resolved will be subject to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.

General Terms

Changes to this Agreement

We may update this Agreement from time to time, for example to reflect changes to the Game, our service providers, or the law. When we do, we will post the updated version on this page and change the "Last updated" date above. If a change is material, we will also give notice in a reasonable way, such as on our website, in the Game's patch notes, or in the Game itself. Unless the law requires otherwise, continuing to play the Game after an update takes effect means you accept the updated Agreement.

Severability

If any provision of this Agreement is found invalid or unenforceable, it will be enforced to the fullest extent permitted, and the remaining provisions will stay in full effect.

Entire agreement

This Agreement is the entire agreement between you and Publisher regarding the PlayStation®5 version of the Game and replaces any prior agreements or understandings on that subject. Your use of PlayStation Network and PlayStation Store is also governed by SIE's own terms, which are separate from this Agreement. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Other policies

This Agreement is the privacy policy for the PlayStation®5 version of the Game. Our website is covered by a separate Website Privacy Policy.
